Privacy Policy — Fit 901

F901, LLC (“Fit 901”, “we”, “us”) operates fit901.com and provides personal training, coaching and related services in Memphis, Tennessee. This policy explains what we collect, why, and what we will and will not do with it.

1. The short version

  • We collect what we need to train you safely and run the business.
  • We do not sell your personal information.
  • We never share your mobile number or your SMS consent with anyone for marketing — under any circumstance, including if the business is ever sold.
  • You can ask us what we hold, ask us to correct it, or ask us to delete it.

2. What we collect

You give us: name, email, postal address, phone number, emergency contact, date of birth, payment details, and the health and training information you provide on intake forms or tell your coach.

Collected automatically: IP address, browser and device type, pages viewed, and referring site. This is ordinary web traffic data.

From your training: attendance, workout results, measurements and progress notes you or your coach record.

3. Health information

Training safely requires knowing about injuries, surgeries, medications and conditions that affect exercise. We use that information solely to program and supervise your training and to respond in an emergency. We share it with your assigned coach and, where you have asked us to coordinate with a clinician, with that clinician. We do not use it for marketing and we do not disclose it to anyone else without your instruction, except where the law requires it.

4. Text messages (SMS)

If you opt in, we text you about your own training: session confirmations and reminders, account and billing notices, and coaching follow-ups.

You opt in either by entering your mobile number on our web form and ticking a consent box that is not pre-checked (confirmed with a one-time code), or in person when you sign your training agreement, which carries the same disclosure above the signature line. Consent to receive texts is never a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to unsubscribe, or HELP for help. Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Who we share information with

We share personal information only with service providers who perform a function for us and may use it for no other purpose: payment processing, scheduling and CRM software, email and SMS delivery, and accounting. They are bound to use it only to provide that service to us.

We also disclose information where the law requires it, or where it is necessary to protect the rights, property or safety of Fit 901, our clients, or the public.

We do not sell personal information, and we do not share it with third parties for their own marketing.

6. Business transfers

If Fit 901 is ever merged, acquired, or its assets sold, client information may transfer as part of that transaction so your services can continue uninterrupted. Any acquirer would be bound by this policy for information collected under it, and we would notify you before your information became subject to a materially different policy.

This does not apply to mobile phone numbers or SMS consent. Text messaging originator opt-in data and consent are excluded from any sale, transfer, assignment or licence of assets, and will never be sold, transferred, or shared with any third party under any circumstance.

7. Website analytics and advertising

We use standard analytics to understand how the site is used. Aggregated, non-identifying traffic statistics may be shared with service providers who help us measure and improve the site. This excludes mobile numbers and SMS consent data, which are never included in any such sharing.

We may use cookies. Most browsers let you refuse them; the site works without them.

8. How long we keep it

We keep client records for as long as you train with us and afterwards for as long as we are required to for tax, insurance and liability purposes. Signed waivers and training agreements are retained for the period our insurers and applicable law require. If you unsubscribe from texts we keep a record of that opt-out, so that we can honour it.

9. Your choices

  • Texts: reply STOP at any time.
  • Email: use the unsubscribe link in any marketing email. We will still send messages about your account and bookings.
  • Access, correction, deletion: contact us and we will respond. Some records we are obliged to retain.

10. Security

We use reasonable administrative and technical safeguards to protect the information we hold. No system is perfectly secure, and we cannot guarantee absolute security. Keep your account password to yourself; you are responsible for activity under your login.

11. Children

We do not knowingly collect information online from anyone under 13. Where a minor trains with us, a parent or legal guardian provides their information and signs on their behalf.

12. Changes

We may update this policy. The date at the top shows when it last changed. Material changes affecting how we use information already collected will be notified to you.
