1. Not medical advice
Everything on this site and in our programs is general fitness information and coaching. It is not medical advice, diagnosis or treatment, and it does not replace your physician. Consult a qualified clinician before beginning any exercise program, particularly if you have a medical condition, are recovering from surgery or injury, are pregnant, or are taking medication that affects exercise.
2. Assumption of risk
Physical training carries inherent risk of injury. You participate voluntarily and assume that risk. You agree to disclose relevant medical history, to follow coaching instruction, and to stop and tell your coach if something hurts or feels wrong.
Nothing in these terms limits liability for gross negligence or willful misconduct, or any liability that cannot lawfully be limited.
3. Your account
Keep your login credentials confidential. You are responsible for activity under your account. Tell us promptly if you believe it has been compromised.
4. Bookings, cancellations and payment
Session booking, cancellation windows, membership terms, freezes and cancellation notice periods are set out in the training agreement you sign, which governs if it conflicts with anything here. Fees are as stated in that agreement.
Where a program is prepaid, the cancellation rights required by Tennessee law apply and are stated in that agreement.
5. Text messages
Our SMS program, including consent, message frequency, rates, STOP and HELP handling and carrier liability, is described in full at SMS Messaging Terms & Privacy, which forms part of these terms.
6. Our content
The content on this site — text, programming, images, video and design — belongs to Fit 901 or our licensors. You may read it and use it for your own personal training. You may not republish, resell or redistribute it, or use it to build a competing product or service, without our written permission.
7. Your content
If you send us reviews, testimonials, photographs or other material, you keep ownership of it and grant us permission to use it in connection with our business. We will not publish a photograph of you, or identify you by full name, without your permission. You can withdraw that permission at any time and we will stop using it going forward.
8. Third-party links
We sometimes link to other sites. We do not control them and are not responsible for their content or their privacy practices.
9. Availability
We aim to keep the site and our services available, but we do not guarantee uninterrupted access. We may change, suspend or discontinue any part of them.
10. Limitation of liability
To the fullest extent permitted by law, Fit 901 is not liable for indirect, incidental, special or consequential damages arising from your use of the site. This does not limit liability for gross negligence or willful misconduct, or any liability that cannot lawfully be limited.
11. Governing law
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. Disputes are subject to the courts of Shelby County, Tennessee.
12. Changes
We may update these terms; the date above shows when they last changed. Continuing to use the site after a change means you accept the updated terms.
